It is a little over six months ago that I began these blogs and now I am beginning the stage of summing up.

Vasant Oswal was brought up in an era when public transport in India relied on horses. From humble beginnings in Pune in the western state of Maharashtra, he went on to become a pioneer in laser surgery in the larynx. He would also receive a Fellowship by Election at the Royal College of Surgeons, not to mention serving as Editor in Chief of ENT and Audiology News.

How do doctors learn to prescribe/use drugs in a safe and effective manner? This is no simple question and when the issue of a prescribing habit being regarded as lethal it becomes highly relevant.

Timelines are very important but how reliable are they? Of course, it depends on the source(s) of the data on which they are based.

If a person is snoring that means they are breathing. If they are breathing and their skin is of a normal colour does that not suggest that they are oxygenating the tissues?

We all know what snoring is, but do we understand what snoring means?

How much does the position of a patient add to the risk of a surgical procedure? This is an extremely important question, and the answer is far from simple.

Because of liability issues there is a reluctance to make clinical practice guidelines (CPG) statutory requirements; that is to say, guidelines are ‘suggestions’, not ‘instructions’. And why is this important to this case?

The issue at stake is one of culpability. Who is to blame when things go wrong? That involves both an awareness of what has actually happened and those responsible for the various elements that have shown to be at fault.

UK professionals have called for aid in sending surgical equipment to Ukraine during Russian invasion.

The Judge continues in her ‘Reasons for Sentencing’ and refers to the expert opinion of Dr Jimmy Chan. I have already indicated the lack of veracity when it comes to matters of fact with Dr Chan. Now we an opportunity to consider the validity of his opinion.

I was troubled by the Judge's response and wondered what a mathematician would have thought of it. So, the following emails ensued:

There are things that we just do not know because it is now too late to find out: what were the oxygen saturation levels, for example? But there are other things we do not know although they are known. Where did Dr Kwan go when she left the operating room?

The Judge just cannot say, “Lee’s airway and oxygenation were not established or maintained”. This is nonsensical from the perspective of a person trained in medicine. Even more senseless from a person who is not. If Lee’s airway was not established and maintained, how did Lee survive a three-hour operation, albeit in the prone position and without developing any signs of cyanosis?

Just to recap; I have been looking at the Reasons for Sentence in the case of HKSAR and Kwan Hau chi, Vanessa. The verdict had been declared: “guilty”. Now, on 4 October 2021, the Hon D’Almada Remedios J is going to present her review of the case and the factors she has taken into account when deciding the sentence. I am referring to an official document which is in the public domain. The case reference is HCCC 200/2018. It is a shameful document, but we must all share in that shame.

The recent Times investigation and subsequent reported investigation by the MHRA on the use of unlicensed botulinum toxin in the UK is something that is sorely needed in a sector that is unregulated.

It is the system that places the Judge as an interpreter of “truths” and sadly, susceptible to false information.

Today is the first day of the Chinese New Year. This is the year of the Tiger. I am fine, I am a Dragon. This is going to be an interesting year.

Risks are ubiquitous in medicine. It is very important to realise that a risk can be both a threat and a friend. Risks relate to probabilities. The probability or possibility that the outcome may not be as desired. The Law does have a perverse view on this. The Law likes, demands, seeks cause and consequence. An honest doctor can rarely satisfy the Law. And that is why it was such a bad thing to see this poor Judge being led by the nose by two unscrupulous Medical “Experts”!

I wonder how fast time goes in prison? 2022.This was Vanessa’s first New Year in prison. Dr Mak’s second. Two female doctors, both in their thirties. Dr Mak graduated from the Chinese University of Hong Kong (CUHK) and Dr Kwan, Vanessa, from Hong Kong University (HKU). Both are now incarcerated on the basis of myths. It is a disgrace.

So now we are entering the third year of this global pandemic. It is changing, evolving and is bringing out the very best and the very worst in humanity. Science and scientists have had a real bashing, but then who by? Quacks, aardvarks and gobbeldygooks. Looking back is looking forward.

In the context of medicine, we typically speak of informed consent as having both an ethical and a legal basis. The ethics are related to patient autonomy and human rights. The legal perspective relates to the definition of what occurs if consent is not obtained, and a physical intervention occurs (assault or battery at a minimum and it would appear, gross negligence if things go wrong).

It is one year ago today that Justice Judianna Barnes sentenced Dr Mak Wan-ling to be incarcerated for three and half years for a crime she did not commit (see parts 1-4 of this blog).

Propofol played a significant role in the trial of Dr Vanessa Kwan. Vanessa went to South Korea to learn about cosmetic surgery. Cosmetic surgeons in South Korea use a lot of propofol in office-based practice. Ipso facto, Vanessa learned about propofol and its use in cosmetic surgery.

South Korea is a truly amazing country and has, over the last thirty years, transformed into one of the most dynamic and innovative economies in the world.

There is no formally recognised specialty of Cosmetic Surgery (and / or Medicine) in Hong Kong. Unsurprisingly, there are no formal training programs in cosmetic surgery or aesthetic medicine.

I wonder what Vanessa is thinking right now. If she can even think. A torrent of images, regrets, what ifs. The onslaught must be so great, no wonder the normal response is for the mind and the body to shut down? Depression.

I want to return to the case of Dr Mak, who was, from the available evidence, caught up in a miscarriage of justice that arose because of a lack of effective interprofessional communication in the legal process.

Little did I know or anticipate what a mess this was going to become: a medico-legal mess with ignorant lawyers and arrogant doctors demonstrating how stupidity and rapacious hypocrisy can twist and distort reality for the purposes of extracting a bizarre social revenge with little sense of justice.

On the 8 December 2020, Justice Judianna Barnes sentenced Dr Mak Wan-ling to three and a half years in prison. The charge for which she was found guilty was gross negligence manslaughter (GNM). She had injected a contaminated blood sample into a patient and the patient had died. The conviction was fundamentally flawed.

Blindness following filler injections is a devastating complication for the patient and the practitioner.

This will be the last ‘Letter from Hong Kong’. I began back in April with a simple message, wear masks.

Since March 2020 it was sensible medical practice to consider making all possible beds in the NHS available to potentially admit ill patients with COVID-19. The expected admission rate was supposed to risk overwhelming the NHS, so independent sector facilities apparently volunteered and were then contracted to the NHS as priority, with full remuneration for their losses, and all private practitioners were effectively frozen out from seeing, admitting and operating on their own self pay patients.

So much can change in just a few weeks. In Hong Kong after three weeks with no new cases we started to see a third wave in mid-July. More and more cases with no obvious source.
